TERMS AND CONDITIONS OF CONTRACTING (TRAVEL AND TOURISM SERVICES)
1. General information

These terms and conditions govern access to and use of the Website and, in particular, the booking and contracting of trips, stays, experiences and tourism services offered through it (hereinafter, the “Terms”).
2. Activity and services offered
Through the Website, tourism services are offered, including but not limited to:

Resort and accommodation bookings

Travel and holiday arrangements
-
Activities and experiences (e.g. surfing, diving, fishing, sporting events)

Ancillary services and assistance related to travel planning and management
Depending on the service, Blue Ocean Tours S.L. may:

provide certain services directly, and/or
-
act as an intermediary/manager between the user and third-party tourism service providers (resorts, activity operators, carriers, etc.), who will be responsible for the actual provision of the contracted service.
3. Applicable documents
In addition to these Terms, the user must have read the Legal Notice, Privacy Policy and Cookies Policy available on the Website.
The contracting of a service may include specific conditions (for example, resort cancellation policies, diving activity requirements, etc.). Such conditions will be displayed during the booking process or included in the booking confirmation/documentation.
In the event of any discrepancy, the specific conditions of the contracted service shall prevail.
4. The user
By accessing and using the Website, the user declares that they:

Provide accurate and up-to-date information

Use the Website lawfully and in accordance with these Terms
The user is responsible for ensuring that the information provided for the booking is correct (names as shown on passports/ID cards, email addresses, telephone numbers, dates, etc.).
5. Booking and contracting process
The user may request or contract services by following the process indicated on the Website. During this process:

Traveller details necessary to manage the booking may be requested

The service may be subject to availability and confirmation by the provider (e.g. resort availability or activity capacity)
Once the process has been completed, the user will receive a confirmation email (or acknowledgement of the request). Where applicable, the confirmation will include details of the service, dates, prices and applicable conditions.
6. Prices, taxes and payments
Prices shown on the Website are expressed in euros (€) and include applicable taxes, unless otherwise stated.
Accepted payment methods are:

Bank transfer
When payment is made by bank transfer, the request/booking may be held for the period indicated on the Website (by default, 5 calendar days), after which it may be automatically cancelled if payment has not been received.
For card payments, the charge may be made at the time indicated during the booking process (e.g. upon confirmation). In certain cases, a pre-authorisation may be carried out to verify available funds.
7. Communications and travel documentation
Communications with the user will be carried out mainly by electronic means (email and, where authorised by the user, WhatsApp).
Booking documentation (vouchers, confirmations, operational instructions, provider information) will be sent by email or made available as indicated.
The user must review the documentation received and notify any errors as soon as possible.
8. Service requirements and user responsibility
Certain tourism services may require:

valid documentation (ID card/passport/visas)
-
compliance with health or entry requirements of the destination country
-
minimum age
-
certifications or physical fitness (e.g. diving activities)
-
acceptance of the provider’s rules (resort/operator)
The user is responsible for meeting these requirements and for following the provider’s safety instructions and operational rules.
9. Cancellations, changes and refunds
Cancellation, change and refund conditions depend on the contracted service and, where applicable, the provider delivering it.
The following shall apply:

the conditions informed during the booking/contracting process, and/or
-
the conditions included in the service confirmation.
9.1 Cancellation by the user
The user may request cancellation through the indicated contact channels. Cancellation may entail:

penalties imposed by the provider
-
management fees
-
loss of deposits/advance payments, where applicable.
9.2 Changes (dates, details, name changes)
Changes are subject to availability and may involve:
-
fare differences
-
provider penalties
-
management fees.
9.3 No-show
Failure to attend at the agreed place and time (“no-show”) may result in the total or partial loss of amounts paid, in accordance with the provider’s conditions.
10. Right of withdrawal
In accordance with applicable regulations, the right of withdrawal may not apply to certain tourism services, particularly where they involve:

accommodation
-
leisure activities
-
tourism services or experiences
scheduled for a specific date or period of performance.
In such cases, the cancellation policy indicated for the contracted service shall apply.
11. Availability and modifications by the provider
All services are subject to availability. If a service cannot be confirmed or provided due to unforeseen circumstances (e.g. provider decisions, extreme weather conditions affecting activities, etc.), Blue Ocean Tours S.L. will manage a reasonable alternative (change, rescheduling or refund) in accordance with:
-
the provider’s conditions,
-
the conditions informed to the user, and
-
applicable regulations.
12. Liability
Blue Ocean Tours S.L. shall be responsible for the proper management of the booking within its scope of action.
Where the service is provided by a third-party provider, the actual performance of the service shall be the responsibility of that provider (accommodation, activity, local transport, etc.), without prejudice to the consumer’s rights under applicable law.
Blue Ocean Tours S.L. shall not be liable for:
-
non-performance due to force majeure or reasonable external causes,
-
actions by the user contrary to requirements, safety rules or provider instructions,
-
indirect or unforeseeable losses.
Nothing herein shall limit the consumer’s mandatory statutory rights.

15. Applicable law and jurisdiction
These Terms are governed by Spanish law.
Where the user acts as a consumer, any dispute shall be submitted to the courts and tribunals determined in accordance with consumer protection regulations. In other cases, the courts and tribunals of Barcelona, Spain, shall have jurisdiction, unless mandatory rules provide otherwise.
16. Amendment of the terms
Blue Ocean Tours S.L. reserves the right to amend these Terms at any time. Users are advised to review them prior to contracting any service.
